TACORI Rewards 2025 Program Terms and Conditions

 

The TACORI Rewards retail incentive program ("Program" or "TACORI REWARDS") is limited to current and participating authorized retailers ("Participating Retailers") of TACORI Enterprises ("TACORI") and their current sales associates. The Program is administered by TACORI and additional terms of service to these TACORI Rewards Terms and Conditions ("Terms") may apply. These Terms govern your use of the Program, products, features and services offered. BY PARTICIPATING AND/OR ACCESSING THE PROGRAM WEBSITE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS, INCLUSIVE OF ANY AND ALL UPDATES.

 

I.     PROGRAM DETAILS & USAGE:

a.     REGISTRATION & PARTICIPATION - To participate in the Program, you must be registered with a dedicated account on TACORIRewards.com.

i.    "Existing Participant" is an associate who previously registered an account on TacoriRewards.com.

ii.     "New Participant" is an associate at a current authorized TACORI retailer who has not previously participated in TACORI Rewards. A New Participant will first need to obtain the TACORI Rewards Access Code for their specific retail location from retail management, and enter this code during the registration process via TacoriRewards.com. Acceptance of these terms will also be required in the registration process.

b.     CLAIMING SALES - To earn rewards in the TACORI Rewards Program for selling Qualifying TACORI Products, you must be a registered participant on TacoriRewards.com. "Qualifying TACORI Product" means product specifically selected by TACORI, in its sole discretion, to incentivize retail associates enrolled in the TACORI Rewards program. To claim rewards for sales of Qualifying Tacori Products, participants will need to log into TACORIRewards.com and submit their claim within the time specified in these Terms.  Claims are matched to known items sold at the participant's retail location. 

i.      A "Full Sale Claim" is a Qualifying TACORI Product sold by one (1) participant in TACORI Rewards. In order to make a Full Sale Claim, the following information is required: date of sale (either the TACORI invoice date for ?Special? orders, or the Retailer invoice date for ?Stock? orders), and an image of the Sales Receipt and/or Authenticity Card (no larger than 5MB, in .png or .jpeg formats only).  Once the claim is submitted, the system will notify the participant if the claim was accepted.   

ii.     Split Sale - A "Split Sale" is a Qualifying Tacori Product sold by two (2) participants in TACORI Rewards. A maximum of two (2) participants can split a sale for any one (1) Qualifying TACORI Products. One participant will need to submit the claim, and indicate that it is a split during the claim process.  In order to make a Split Sale Claim, the following information is required: date of sale (either the TACORI invoice date for ?Special? orders, or the Retailer invoice date for ?Stock? orders), and an image of the Sales Receipt and/or Authenticity Card (no larger than 5MB, in .png or .jpeg formats only).  Once the claim is submitted, the system will notify the participant if the claim was accepted.   

c.      TYPES OF REWARDS

i.     "Cash Rewards" are an aspect of the TACORI Rewards program.  In order to earn Cash Rewards, the participant must be employed by a retailer that has opted in to participating in Cash Rewards.

1.     Cash Rewards are earned on Qualifying Products, listed below.  Qualifying Products are subject to change, at any time, in TACORI's sole discretion.

a.     18k Gold and Platinum Engagement Rings, Wedding Bands, Men?s Bands, Eternity Bands and Fine Jewelry.

Qualifying TACORI Products specifically excludes the following:

i.                All items made of 14KT gold or Silver denoted by metal code.

ii.              Retired and/or discontinued items.

ii.     Repairs, remakes and/or upgrades of any kind.  

 

2. Cash Rewards unit counts, multipliers, amounts and bonuses are subject to change at any time in TACORI's sole and exclusive discretion.  Any changes to the Cash Rewards unit counts, multipliers, amounts, and bonuses will be communicated to participants in advance via email or through the Program website. Failure to claim by monthly cut-off time frames will result in cash rewards of baseline amounts, and all multipliers and bonuses are forfeited automatically, and cannot be reversed.

 

3. Cash Rewards are subject to offset, deduction or return to TACORI for returned product, any claim in violation of these Terms, any claim for sales not made to a bona fide consumer and/or any fraud, technical failures or any other factor beyond TACORI's reasonable control that impairs the integrity or proper functioning of TACORI Rewards, as determined by TACORI in its sole discretion.  

 

ii.      "Passion Points" are reward points earned through the sale of TACORI products. All TACORI product categories are eligible for Passion Points, with the exception of repairs, remakes, or upgrades. The number of Passion Points earned per sale is determined by the participant's individual TACORI Rewards level of achievement (?Tier Status?) and MSRP value of the TACORI product sold. Passion Points have no cash value or equivalent and are only redeemable for select TACORI products pursuant to the Terms. 

1.     Tier Status is determined by the total MSRP value of claimed sales in a calendar year.  Each year, the total MSRP value of sales determines the participant tier status through the end of the next calendar year.  In January 2025, participant tier status will be established based on the total MSRP value of claims in 2024.  Tier Status qualifications can be found on TACORIRewards.com, and are subject to change at any time in TACORI's sole and exclusive discretion.

2.     "Passion Point Multiplier" is the way in which MSRP sales are converted to points.  Sales Associates receive Passion Points equivalent to the MSRP value of their claimed sales, multiplied by the Passion Point Multiplier corresponding to their Tier Status.  When a Sales Associate claims enough value in MSRP to elevate their current Tier Status, their Passion Point Multiplier changes to reflect their new Tier Status.  This new Passion Point Multiplier will only be applied to their claims moving forward from the time that they achieved that Tier Status, and will not be retroactively applied to claims preceding their achievement of that tier. Passion Points Multipliers and qualifying MSRP totals can be found on TACORIRewards.com, and are subject to change at any time in TACORI's sole and exclusive discretion.

 

iii. Payment is reliant on submitted & approved W9 documentation that reflects the participants correct information, as well as correct & complete Zelle information.  Failure to provide and/or update W9 and Zelle information will result in delayed payment. Participants must ensure their W9 and Zelle information is accurate. If any information is incorrect or missing, TACORI will attempt to request updated details twice per calendar year. Failure to respond may result in delayed or forfeited rewards.  TACORI will attempt to request updated W9 and Zelle information a total of two (2) occurrences per calendar year, after which, the participant cash rewards will be held until the participant initiates the information and/or correction of information.  Failure to comply with TACORI requirements may result in forfeiting all rewards and suspension from participating in the TACORI Rewards program.

iv. Any and all return item(s) or item(s) previously subject to a claim for any TACORI Rewards cannot be used for any additional TACORI Rewards. Any claim for Cash Rewards, Cash Bonuses or Passion Points are for the first sale of that item only. Further, Passion Points are subject to offset, deduction or return to TACORI for returned product, any claim in violation of these Terms, any claim for sales not made to a bona fide consumer and/or any fraud, technical failures or any other factor beyond TACORI's reasonable control impairs the integrity or proper functioning of TACORI Rewards, as determined by TACORI in its sole discretion.   

 

d.     REDEMPTION

i.     Cash Rewards and Cash Bonuses are paid out on a monthly basis, provided by TACORI through the bank of TACORI's choice. Cash Rewards and Cash Bonuses are typically paid by the 25th of the following month (i.e. Cash Rewards earned from January 1 - January 31, 2025 will be paid to the participating associate by February 25th, 2025). In order to receive a Rewards payout, the participant will need to have submitted a W9 form to TACORI W9 forms can be mailed to TACORI Enterprises, 1736 Gardena Ave. Glendale, CA 91204

ii.    Passion Points are redeemable for select TACORI in stock products by calling TACORI's Customer Excellence team at 818-863-1536. The redeemable value of Passion Points can be found on TACORIRewards.com, and is subject to change at any time in TACORI's sole discretion.  Passion Points are non-transferable, and purchases must be made by the account holder solely.  Once Passion Points are redeemed, the respective Passion Points used will be deducted from the participant's TACORIRewards.com account. TACORI cannot accommodate purchases of product through a combination of Passion Points and another form of payment (e.g. cash, credit card). 

iii. Claim Window. Any and all rewards, including, but not limited to, Passion Points and Cash Rewards, must be claimed within fifteen (15) days after the monthly rewards cycle ends, provided all terms herein are also met. Claims submitted outside of the deadline will only be eligible for standard Cash Rewards, with no additional multipliers or bonuses applied.

 

II.     INTELLECTUAL PROPERTY RIGHTS. The content on the Website, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, digital downloads, data compilations, interactive features ("Content") and the trademarks, service marks, graphics, scripts, and logos contained therein ("Marks"), are owned by or licensed to TACORI, subject to copyright, trademark and other intellectual property rights under the law. Content and Marks on the Website are provided to you as is, where is, for your informational use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of TACORI.

 

III.     YOUR ACCOUNT. You are responsible for maintaining the confidentiality regarding your account, including but not limited to, passwords and usernames. Furthermore, you agree to accept responsibility for all activities and transactions that occur under your account or password. TACORI reserves the right to exclude individuals from the Program or remove Passion Points and/or Cash Rewards from an individual's rewards in its sole and exclusive discretion, which includes, but is not limited to, any abuse, manipulation or "gaming" of the Program or its rules and Terms (as determined by TACORI in its sole discretion), failure to follow any Terms of the Program, and any misrepresentation or any conduct detrimental to the interests of Sponsor not otherwise protected by law may subject individuals to deduction of Passion Points and/or Cash Rewards obtained through these abusive or manipulative activities and will affect eligibility for further participation in the Program. As such, TACORI also reserves the right, in its sole discretion, to refuse service, disable accounts, remove or edit content, or terminate orders. Your account is a good standing account only if you have agreed to these Terms and have logged in at least once in the last 12 months. Any accounts that are deemed inactive for longer than 12 months will be deactivated. Any rewards in accounts deactivated due to inactivity will be forfeited upon deactivation.

IV.     COMMUNICATION VIA EMAIL. By accepting the official rules during registration, you agree to communication from TACORI including but not limited to Tacori Rewards news, special offers, promotions and other brand communications. You can unsubscribe at any time. V.     COMMUNCIATION. Participant understands, agreed and consents to receive communication, including, but not limited to, email and/or telephone communications from TACORI, and/or its retail partners in regards to these Terms and TACORI Rewards.

 

VI.     GENERAL REWARD CONDITIONS: As applicable, you shall be solely responsible for all federal, state, and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the Rewards. 

 

VII.     USE OF MATERIALS VIA THE WEBSITE AND UPDATES. You may use the TACORI Website and the TACORI Rewards Website ("TACORI Websites") solely in accordance with these Terms. You may not incorporate any portion of the TACORI Websites into your own websites or programs, or compile any portion of it in combination with your own websites or programs. You may not use the TACORI Websites for any illegal purpose. When you use the TACORI Websites, you may also be using the services of third parties. Your use of these third party services may be subject to separate policies, and you agree to be bound by third party policies in addition to these Terms. You agree not to encourage, assist or authorize any copying, modification, reverse engineering, decompiling or disassembling, or tampering with any portion of the TacoriRewards.com Website, or creating any derivatives from any portion of the Website. TACORI or approved partners may undertake automatic or manual updates to the Website at any time and without notice to you.

 

VIII.     Limitation Of Liability. IN NO EVENT SHALL TACORI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT TACORI SHALL NOT BE LIABLE FOR USER GENERATED CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

 

IX.     INDEMNITY. You agree to defend, indemnify and hold harmless TACORI, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the TacoriRewards.com Website; (ii) your violation of any term of these Terms; or (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right, (iv) use of the Program and/or (v) redemption(s).

 

X.     GOVERNING LAW/JURISDICTION:  ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE TERMS OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE PROMOTION OR PROGRAM SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF CALIFORNIA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS.

 

XI.     YOU AGREE THAT ANY DISPUTE OR CLAIM RELATING IN ANY WAY TO YOUR USE OF THE PROGRAM, SERVICES AND/OR REDEMPTION WILL BE RESOLVED EXCLUSIVELY THOUGH FINAL AND BINDING ARBITRATION INDIVIDUALLY, AND WITHOUT RESORT TO CLASS ACTION, EXCLUSIVELY BY BINDING ARBITRATION IN LOS ANGELES, CALIFORNIA.   

 

XII. TACORI may, in its sole discretion, alter, limit, or modify the Terms, rules, regulations, benefits, Rewards, eligibility, or any other feature of the Program (including assigning any of its obligations to customers under the Program at any time to another person or entity, without recourse) or may terminate the Program any time at its sole discretion. Please check regularly for any changes. It is your responsibility to check or review these Terms from time to time to keep informed of any changes. By joining the Program, you hereby agree to be bound by these Terms, including any changes to these Terms in TACORI's sole discretion. Further, you understand and agree that TACORI Rewards are subject to offset, deduction or return to TACORI for returned product, any claim in violation of these Terms, any claim for sales not made to a bona fide consumer and/or any fraud, technical failures or any other factor beyond TACORI's reasonable control impairs the integrity or proper functioning of TACORI Rewards, as determined by TACORI in its sole discretion.
